The Declaration of Covenants, Conditions, and Restrictions for Buffalo Heights states that owners are subject to mandatory Home Owner’s Association membership, bound by its rules and regulations. 

Buffalo Heights HOA is a nonprofit organization that manages a private, planned community.

Texas Property Codes

Below, you will find references to areas of the Texas Property Code that govern property owners’ associations and issues related to property owners’ associations. Title 11 of the Property Code concerns property owners’ associations, but below are the chapters we refer patrons to most frequently. If you find these statutes difficult to understand, you may want to look at the “plain English” resources on this page or speak to an attorney.

Texas Property Code ch. 209
The “Texas Residential Property Owners Protection Act” covers various issues such as board governance, elections and voting, record-keeping and an owner’s right to access records, protections regarding third-party collections, required notices, foreclosures for assessment liens, and regulations on leases.

Texas Property Code ch. 202
This chapter discusses “restrictive covenants” in general, their construction, and their enforcement. It lists certain restrictions prohibited by law and contains a provision related to an association’s duty to file dedicatory instruments with the county.

Texas Constitution and Statutes
The remainder of Title 11 of the Property Code, which deals with restrictive covenants and property owners’ associations, can be found online. Title 11 contains Chapters 201-215 of the Texas Property Code. Most chapters specify that they only apply to certain associations — see the “Applicability of Chapter” sections in each chapter for more information.
